EU MDR vs. US FDA: Key Regulatory Differences for Medical Device Manufacturers
Exporting medical devices to both the European Union and the United States means navigating two fundamentally different regulatory systems. While both aim to ensure device safety and effectiveness, they differ in legal framework, classification rules, conformity assessment, and post-market obligations. This guide breaks down the key differences for manufacturers planning market entry.
1. Legal framework: one regulation vs. layers of statutes
The EU operates under the Medical Device Regulation (MDR) 2017/745, which replaced the older Medical Devices Directive (MDD) and became fully applicable on 26 May 2021. It is a single, directly binding regulation across all EU member states.
The US system is governed by the Federal Food, Drug, and Cosmetic Act, with device-specific requirements under Title 21 CFR Part 820 (Quality System Regulation, QSR). The FDA also relies on guidance documents and recognized consensus standards rather than a single consolidated regulation.

2. Classification: 4 classes vs. 3 classes

3. Conformity assessment: notified bodies vs. FDA review
In the EU, most devices (Class IIa and above) require assessment by an independent notified body — a private organization designated by national authorities. The manufacturer must obtain a CE mark before placing the device on the market.
In the US, manufacturers typically go through FDA premarket notification (510(k)) for Class II devices or Premarket Approval (PMA) for Class III devices. Note that the FDA no longer requires a separate Quality System submission — the 21 CFR Part 820 requirements were harmonized with ISO 13485 under the 2024 QMSR update.
4. Clinical evaluation: EU demands more
The MDR significantly tightened clinical evidence requirements. Manufacturers must produce a clinical evaluation report (CER), and for higher-risk devices, clinical investigations may be mandatory. Post-market clinical follow-up (PMCF) is now a standing obligation, not a one-time activity.
The FDA accepts a broader range of evidence for 510(k) clearance — primarily substantial equivalence to a legally marketed predicate device. Only PMA devices require full clinical data comparable to EU clinical investigations.
5. Post-market surveillance: ongoing vs. event-driven
The MDR requires a structured post-market surveillance (PMS) system, including a PMS plan, periodic safety update reports (PSUR), and continuous updating of the clinical evaluation. EUDAMED — the EU's central database — tracks registered devices, certificates, and vigilance events.
The FDA relies on Medical Device Reporting (MDR) for adverse events, plus recalls and corrections reporting. The agency does not require periodic safety update reports in the same form as the EU.
6. Practical tips for exporters
- Start with classification — it drives everything else in both systems. Get it wrong and the entire compliance pathway changes.
- Build a QMS that satisfies both ISO 13485 and 21 CFR Part 820 — the 2024 QMSR alignment makes a single QMS largely acceptable to both.
- Budget more time and cost for the EU route — notified body capacity is limited and MDR clinical documentation is heavier.
- Keep your EU Authorized Representative and US Agent roles distinct — both are mandatory but serve different functions.
